Welcome to J Mart ("J Mart", "we", "our", or "us"). These Terms of Service govern your access to and use of our website, products and services available at www.jmart.nz.

1. Eligibility

You must be at least 18 years old or have the permission of a parent or legal guardian to use our Services.

You are responsible for maintaining the confidentiality of your account and password.

We make every effort to ensure product descriptions, pricing and images are accurate.

However:

  • Product colours may vary depending on your screen.
  • Packaging may differ from images shown.
  • Fresh food and produce may naturally vary in size, appearance and weight.
  • Product availability may change without notice.

We reserve the right to discontinue products or limit quantities.

3. Orders

Placing an order constitutes an offer to purchase.

We reserve the right to accept or reject any order at our discretion.

An order is not accepted until payment has been received and we have confirmed acceptance.

If we discover pricing errors, stock shortages or other issues, we may cancel or amend your order and provide a full refund where applicable.

4. Pricing

All prices are shown in New Zealand Dollars (NZD).

Prices include GST unless otherwise stated.

Prices, promotions and product availability may change without notice.

Delivery charges are calculated separately during checkout.

5. Payment

Payment must be completed before an order is processed.

We accept payment methods displayed during checkout.

You warrant that you are authorised to use the payment method provided.

6. Shipping & Delivery

Delivery times are estimates only.

We are not responsible for delays caused by couriers, customs, weather, public holidays or events outside our reasonable control.

Risk in the goods passes to you once your order has been delivered to your nominated delivery address.

Ownership of goods remains with J Mart until payment has been received in full.

7. Returns & Refunds

Returns are governed by our Refund Policy available on our website.

Nothing in our Refund Policy limits your rights under the Consumer Guarantees Act 1993.

8. Food Products

Due to the nature of food products:

  • Appearance, colour and weight may vary.
  • Availability may change due to seasonal supply.
  • Fresh, chilled and frozen foods cannot be returned due to a change of mind once delivered for food safety reasons.

This does not affect your rights under the Consumer Guarantees Act.

9. Consumer Guarantees Act

Nothing in these Terms excludes, restricts or modifies any rights you may have under:

  • Consumer Guarantees Act 1993
  • Fair Trading Act 1986
  • Privacy Act 2020
  • or any other applicable New Zealand legislation.

Where goods are supplied for personal, domestic or household use, your rights under the Consumer Guarantees Act cannot be excluded.

Where goods are acquired for business purposes, and permitted by law, the Consumer Guarantees Act may not apply.

10. Intellectual Property

All website content, including text, graphics, logos, images, product descriptions and trademarks, remains the property of J Mart or its licensors.

No content may be copied, reproduced or distributed without our written permission.

11. Website Use

You agree not to:

  • use the website for unlawful purposes;
  • interfere with the operation or security of the website;
  • upload malicious software or viruses;
  • scrape or copy website content without permission;
  • impersonate another person.

We reserve the right to suspend or terminate access where these Terms are breached.
